Terms of Use and Membership

1. About these Terms

These Terms govern use of the Vital Collective app, website and related member services (“Vital”). Vital is operated by Clay Theakston, trading as Vital Collective (“we”, “us”, “our”).

By creating an account or using Vital, you agree to these Terms and any policies expressly incorporated into them, including the Privacy Notice and Community Rules. If you do not agree, do not use the service.

2. Eligibility and accounts

You must be at least 18 years old to create a Vital member account. Adults may use Vital with children in their care and may enter limited family information for personalisation.

  • Provide accurate account information and keep it reasonably up to date.
  • Keep login credentials secure and tell us promptly if you believe your account has been compromised.
  • Do not create accounts for impersonation, evasion of restrictions, fraud or abuse.
  • You are responsible for activity carried out through your account unless caused by our failure to use reasonable care.

3. What Vital provides

Vital provides family activity ideas, printable resources, discovery tools, Saved items, Community features and related account/member functionality. Features may evolve over time, but we will not remove or materially change paid functionality in a way that unlawfully deprives consumers of what they purchased.

4. Membership and subscriptions

Vital membership is intended to be available at £9.99 per month or £59.99 per year. The annual plan is approximately half the cost of paying monthly for twelve months. A standard 7-day free trial is intended to be available to eligible new subscribers. Eligible partner groups, promotional campaigns or retention offers may receive different discounts or longer trial periods. The exact price, billing interval, trial/offer terms, renewal date and material subscription information will always be shown before purchase.

  • Mobile subscriptions are sold through Apple App Store or Google Play and are subject to the billing platform’s purchase and payment processes.
  • Unless clearly stated otherwise before purchase, a free or discounted trial converts automatically to the selected paid subscription at the displayed price when the trial ends, and recurring subscriptions renew automatically until cancelled.
  • Members can manage or cancel a recurring mobile membership through the in-app Vital membership area, which links to the relevant Apple or Google subscription-management flow.
  • Cancellation stops future renewal but does not normally end access already paid for before the end of the current billing period, unless law or the billing platform provides otherwise.
  • Refunds and statutory cancellation rights are handled in accordance with applicable consumer law and, where the platform is the seller/merchant of record, the platform’s applicable process.
  • If a price changes, we will provide any notice required by law or the billing platform before the new price applies.

Nothing in these Terms limits statutory rights that cannot lawfully be excluded.

5. Free newsletter and marketing

Vital may offer a free email newsletter to non-members as well as members. The newsletter is separate from Vital membership. Where consent is required, a person actively opts in; purchasing or trialling Vital does not automatically subscribe them to marketing.

The newsletter may include family ideas, Vital news and occasional promotional or partner offers. Subscribers can unsubscribe at any time. Essential account, security or service communications are not marketing.

6. Activity and safety information

Vital provides general activity ideas and practical information, not professional medical, childcare, educational, nutritional, legal or safety advice.

  • An adult remains responsible for deciding whether an activity is suitable for the people taking part and for providing appropriate supervision.
  • Consider age, ability, weather, surroundings, traffic, water, heights, tools, allergies, food hygiene, medical needs and any other relevant risks.
  • Follow product instructions and local rules where equipment, public spaces or third-party facilities are involved.
  • If an activity involves interviewing or approaching an unfamiliar adult, a parent or guardian should be present.
  • Stop an activity if conditions become unsafe or unsuitable.

These provisions do not exclude or limit liability where it would be unlawful to do so, including liability for death or personal injury caused by our negligence.

7. Printable resources and Vital content

Unless stated otherwise, Vital’s activities, writing, designs, printable resources, branding and software are owned by or licensed to Vital Collective and are protected by intellectual-property law.

A valid member receives a limited, non-exclusive, non-transferable licence to access Vital content and to print/download resources made available for personal and family use. You must not sell, republish, redistribute, scrape, copy at scale, create a competing content library from, or commercially exploit Vital content without written permission.

8. Community

Community is intended to be useful, supportive and safe. Before posting, members must accept the Community Rules or equivalent user policy presented in the app.

  • Be kind. Disagreement is allowed; bullying, harassment, hate, threats and abuse are not.
  • No advertising, sponsored posts, affiliate links, commercial solicitation or promotional self-posting.
  • Protect privacy and do not share another person’s personal information, private messages or identifying details without permission.
  • Think carefully before sharing information or images relating to children.
  • Keep content relevant to family life, Vital activities and the Vital sections.
  • No illegal, exploitative, sexually explicit, graphically violent, fraudulent, spam or scam content.
  • Do not impersonate others or deliberately spread dangerous misinformation.
  • Report content that breaks the rules rather than starting a pile-on.

9. Your Community content

You keep ownership of content you create. By posting content to Community, you give Vital a non-exclusive, worldwide, royalty-free licence to host, copy, display, format and technically process that content only as reasonably needed to operate, secure, moderate, improve and provide Community. This licence ends when the content is deleted, except for copies that must temporarily remain in backups or records lawfully retained for safety, legal or evidential reasons.

You confirm that you have the rights and permissions needed to post your content and that it does not unlawfully infringe another person’s rights.

10. Moderation, reporting and blocking

We may review, hide, remove or restrict content or accounts where reasonably necessary to enforce these Terms or the Community Rules, respond to reports, protect users, comply with law or maintain service integrity. We aim to act proportionately and keep appropriate moderation records.

11. Starter content

Vital may use clearly disclosed starter profiles and starter conversations to demonstrate how Community works while the membership is new. Starter content is internally identified, excluded from genuine member/engagement metrics and must not be presented as genuine customer testimony or reviews.

12. Prohibited use

  • Attempting to gain unauthorised access to Vital, another account or underlying systems.
  • Interfering with security, rate limits, access controls or technical safeguards.
  • Using automated tools to scrape or extract substantial parts of Vital without permission.
  • Using Vital to harass, exploit, deceive, defraud or harm another person.
  • Uploading malware or attempting to disrupt the service.
  • Using the service in a way that violates applicable law or another person’s rights.

13. Third-party services and links

Vital may rely on third-party app stores, payment providers, hosting providers or links to external services. Those providers may have their own terms and privacy notices. We are not responsible for third-party content or services we do not control, but this does not affect any responsibility we cannot lawfully exclude.

14. Availability and changes

We aim to keep Vital available and reliable but cannot promise uninterrupted service. We may maintain, secure, improve or change the service. If a material change affects paid consumer rights, we will handle it in accordance with applicable law.

15. Suspension and termination

We may suspend or terminate access where reasonably necessary for serious or repeated breach of these Terms, safety risks, fraud, unlawful use, security risk or non-payment. Where appropriate, we will give notice and an opportunity to remedy the issue, unless immediate action is justified.

16. Account deletion

Members can request secure account deletion through the app. Account/profile, avatar/bio, family, preferences and Saved data are deleted; Community posts/replies are deleted, although a neutral deleted-content marker may remain where needed to preserve replies written by other members. Limited records may be retained only where genuinely required for legal, accounting, security, fraud-prevention or dispute purposes. Deleting a Vital account is separate from cancelling an Apple/Google subscription, so the deletion flow will clearly explain any additional subscription-cancellation step.

17. Consumer rights and liability

Nothing in these Terms excludes rights or remedies that UK consumer law says cannot be excluded. We do not exclude or limit liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded.

Subject to those protections, Vital is not responsible for losses that were not reasonably foreseeable when the contract was made, or for business losses arising from a consumer’s personal use of the service.

18. Complaints

Please contact info@vitalcollective.co.uk first if you have a complaint. We will aim to investigate and respond fairly. If an applicable consumer dispute-resolution scheme becomes relevant to Vital, we will provide the required information.

19. Changes to these Terms

We may update these Terms where reasonably necessary for legal, security, technical or service reasons. We will give appropriate notice of material changes and will not use a change clause to remove mandatory consumer rights.

20. Governing law

These Terms are governed by the laws of England and Wales. If you are a consumer living elsewhere in the UK, you retain any mandatory protections and rights to bring proceedings in the courts available to you under applicable law.
